1. Acceptance of Terms and Conditions

1.1 These terms & conditions (“Terms”) govern your access to and use of:

(a) this website (and any other website maintained by UniHealth) (“Website”) and;

(b) the online member services (“OMS”) and mobile member application (“MMA”);

(e) Healthcare Services applications

that are maintained by UniHealth (collectively referred to as the “Online Services”)

Please read the Terms carefully before you use the Website or register for the Online Services. By accessing the Online Services, you agree to be bound and abide by these Terms.

1.2 Your use of the Online Services is also subject to our Privacy Policy. The personal information you provide when you register for and use the Online Services will be managed in accordance with this Policy.

1.3 UniHealth reserves the right to periodically update these Terms and our Privacy Policy. Your continued use of the Online Services means that you accept those changes.

1.4 By registering for our Online Services, you agree to UniHealth sending you marketing, promotional and other commercial e-mails, unless you opt out. You can opt out of receiving these emails at any time by contacting us at info@unihealthinsurance.com.au.

1.5 UniHealth has a Facebook social media page (‘Social Media Page’).

All of the content on our Social Media Page is subject to individual terms of use prescribed by the social media platform. These include:

We encourage you to access our Social Media Page, but ask that you act respectfully and responsibly. In accessing and communicating with UniHealth via our Social Media Page, you agree to be bound by the individual terms of use of those social media platforms.

We do not agree with or endorse, nor are we responsible for any comments, information, opinions, images, or other content posted by individual users on our Social Media Page. Such information reflects the point of the view of the individual user and not that of UniHealth. UniHealth does not accept any responsibility or liability (either direct or indirect) for any loss or damage arising in connection with the use of (reliance on) any information, links or other content posted on our Social Media Page by individual users.

UniHealth will review content posted (including links) on our Social Media Page and will remove content we determine to be inappropriate.

2. UniHealth Online Services

2.1 UniHealth will provide its policy holders, who register for OMS and MMA, online access to their private health insurance policy information.

2.2 UniHealth reserves the right to control a policy holder’s access to the Online Services. At its discretion, UniHealth may suspend or terminate a policy holder’s access to the Online Services. UniHealth will not be liable to the policy holder for any termination or restriction of access to the Online Services.

2.3 UniHealth reserves the right to modify or discontinue, all or any part of the Online Services at any time, with or without notice. You agree that UniHealth will not be liable for any changes, suspension or discontinuation of all or any of the Online Services.

3. Your obligations

3.1 When using the Online Services, you agree to the following:

(a) you are eighteen (18) years of age or over;

(b) you are responsible for all content that you upload or otherwise provide to UniHealth via the Online Services;

(c) all information provided during registration must be true, accurate, current and complete. To join UniHealth, you must provide your real name, birth date and email address. If you provide false or incomplete information or if UniHealth has reasonable grounds to suspect you have, UniHealth may suspend or terminate your registration and refuse any access to the Online Services;

(d) you will not use the Online Services to access information or perform services related to another person unless expressly permitted by us or an authorised person;

(e) you will not transmit any unsolicited messages, any offensive or harmful, material or software through the Online Services;

(f) you will not impersonate or misrepresent any person, policy holder or anyone covered by a UniHealth insurance policy;

(f) you are responsible for your use of the Online Services, the use of any tools on the Website and any breach of these Terms by any persons authorised by you to use your Online Services account;

(h) you will not use the Online Services for any illegal purpose, violate any laws, infringe on third-party rights or violate these Terms, including actions that compromise website security or disrupt other users.

4. Policy holder registration and security ID (login ID, password and security questions)

4.1 To access our Online Services as a policy holder, you must first complete the registration process outlined on the Website and/or the Online Services.

4.2 You are responsible for keeping your Online Services account access details including your password, PIN number and other security information secure and confidential. If you disclose your Online Services account access details to a third party, you are fully responsible for all changes to your Online Services account and policy.

4.3 If you lose your Online Services account access details, your personal information could be at risk, and actions may be taken in your name. Notify UniHealth immediately if your Online Services account access details are compromised or used without authorisation.

4.4 You must ensure that you exit from (i.e., log out of) your Online Services account at the end of each session.

5. Links

5.1 UniHealth may publish links to third-party websites through its Online Services. UniHealth is not responsible for the content, hyperlinks and information on linked sites. We do not control the availability, endorse them, or assume responsibility for their accuracy. These links are for your convenience, and by accessing them, you agree to the terms imposed by those sites. Use or reliance on the contents of those websites is at your own risk.

5.2 You acknowledge and agree that UniHealth is not responsible, either directly or indirectly, for any damages or losses caused or alleged to have been caused by, or in connection with, the use of or reliance on third-party website content.

6. Online Services content, operations, functions, and disclaimers

6.1 UniHealth provides the Online Services “as is” and “as available” basis, which may contain errors, faults, and inaccuracies.

6.2 Through the Online Services, UniHealth provides access to general health information and details about products and services.

The information provided is not intended to be a substitute for medical advice, diagnosis, or treatment. Always seek the advice of a qualified medical professional regarding a medical condition. Unless specifically stated, the mention of specific products, services and providers does not constitute or imply a recommendation or endorsement by UniHealth.

6.3 Your use of the Online Services is at your own risk. UniHealth expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. It is your responsibility to ensure that any products, services or materials referred to on the Online Services meet your specific requirements.

6.4 Any material downloaded through the Online Services is done at your own risk. UniHealth is not responsible for any damage to your computer system or loss of data that results from the downloaded material.

6.5 No advice or information, whether oral or written, obtained by you through or from the Online Services shall create any warranty not expressly stated in the Terms.

6.6 Any results from any tools, calculations or simulations available on the Online Services are indicative only and are neither a quote nor a pre-qualification for insurance cover.

6.7 UniHealth has used its best endeavours to ensure that the content on the Online Services, is correct and current. However, the content may include errors or events may occur, which cause the information to become inaccurate or outdated. Accordingly, to the maximum extent permitted by law, UniHealth does not warrant the reliability, accuracy, quality, currency or completeness of the content on the Online Services and takes no responsibility for any error, omission or defect.

6.8 The content of the Online Services is subject to change without notice.

6.9 Information about providers and preferred providers does not represent an endorsement or recommendation by UniHealth. Members should conduct their own inquiries and seek any assurance from the provider of the service or product.

6.10 You confirm that, where appropriate, you have obtained the consent from a parent or guardian for any person under the age of eighteen (18) who is featured in content posted on any of our Online Services.

6.12 Viruses and security

UniHealth does not represent or warrant that the Online Services are free from viruses, defects or errors which may affect your software or systems. Implement your own security measures to protect your software and systems.

7. Exclusions and limitations

7.1 Implied terms

If you use the Online Services, the Competition and Consumer Act 2010 (Cth) or similar legislation may imply certain non-excludable terms, conditions, or warranties. If UniHealth breaches any of these, liability will be limited at UniHealth’s discretion, to either:

(a) re-supplying the relevant goods, services or information; or

(b) paying the cost of these to be supplied again.

7.2 Exclusion of liability

Except to the extent liability cannot be lawfully excluded, UniHealth will not be liable for:

(a) any loss of profit, loss of data, loss of use, damage to goodwill or loss due to delay, or any direct or indirect loss or damage (including, without limitation, consequential loss or damage), caused by your use or inability to use the Online Services; or

(b) any cost, loss, liability or expense arising from death, personal injury or property damage resulting directly or indirectly from your use of the Online Services.

7.3 Indemnity

You agree to indemnify UniHealth (and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees) and hold them harmless against all losses, costs, claims and damages arising from:

(a) any breach by you of these Terms; or

(b) any third-party claims due to your conduct or any content accessed through your Online Services account.

8. Intellectual property rights

8.1 The content of the Online Services is protected by copyright, trade mark and other intellectual property laws.

8.2 The materials and content accessed on the Online Services (including software and web designs) contain proprietary information protected by Australian intellectual property and other laws. You may view this content online or print a copy for personal use. Any other use, copying or reproduction (including reproduction on other online services or systematic downloading) is prohibited. Unless expressly stated otherwise, nothing contained in the Online Services should be construed as a licence or right of use of any trade mark without the express written permission of the owner of the trade mark.

8.3 You must not alter any copyright notice, alter, or commercially use any trademark, logo or names (including business and domain names). You agree not to otherwise copy, change, adapt, communicate, sell or otherwise deal with the material available on the Online Services.

8.4 UniHealth retains all rights to its online documents and may use them or the information on them for any of its purposes, subject to its Privacy Policy, the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

8.5 By contributing content, you confirm you own or have the right to use any material included in your content, that you have the permission of anyone appearing in it and that you are not infringing any third-party rights by submitting the content.

8.6 You grant UniHealth a royalty free, non-exclusive licence to use the content. UniHealth has ultimate editorial control over all its Online Services and may edit, remove or exercise its discretion not to publish your contribution for any reason whatsoever.

9. General

9.1 Other terms and conditions

These Terms are in addition to the terms and conditions in:

(a) the Fund Rules;

(b) the Privacy Policy:

(c) any specific transactions you’ve undertaken with UniHealth;

(d) any additional terms or guidelines outlined within the specific online service you access; and

(e) any third-party documents and websites accessed via the Online Services.

9.2 Waiver

Any failure by UniHealth to exercise or enforce its rights under these Terms will not constitute a waiver of such rights unless stated in writing.

9.3 Change of your details

You must inform UniHealth of any change to your name, address, or other details within two (2) months of the change. You can update your details directly through our Online Services, by calling or emailing us.

9.5 Governing law

The laws of New South Wales, Australia govern these Terms, and both you and UniHealth submit to the exclusive jurisdiction of the Courts of that State.
